The law today
Nebraska has no state license or registration for making or selling consumable hemp products; the only license a hemp business needs from government is a USDA hemp producer license to grow (the state stopped issuing cultivator licenses on Jan 1, 2025 under LB 262). The Hemp Farming Act defines hemp as cannabis with not more than 0.3% delta-9 THC, and there is no state statute setting an age minimum or per-serving THC cap for hemp products.
LB 316, which would have banned most consumable hemp and THC products, stalled in May 2025 and was indefinitely postponed on April 17, 2026, so no ban is in force; however the Attorney General has sued retailers of delta-8/synthetic THC products as unlawful under the Uniform Controlled Substances Act, and Governor Pillen's EO 26-02 (Jan 27, 2026) ordered agencies to review rules on synthetic THC in food and beverages ahead of the federal hemp redefinition.
Medical cannabis is regulated separately by the Medical Cannabis Commission.

- Research notes
- NDA hemp page and Hemp Farming Act verified; LB 316 status (indefinitely postponed 2026-04-17) taken from the official bill page. Could not verify any NE Department of Revenue hemp tax page or AG enforcement page. Age-21 and potency limits are not in statute – treat as unregulated at state level. Medical Cannabis Commission site loads but does not address hemp.
- Good Hemp Distro market notes
- No statute bans intoxicating hemp (LB 316 died Apr 2026) but the AG has filed 15+ suits and 200+ cease-and-desist letters and a zero-THC food rule is pending. High enforcement risk; closed. (Recreational (21+) state dataset, version 2026-09-28)
