- MI 2021 Public Acts 56โ58 โ all THC regulated as marihuana under MRTMA/CRA โ effective October 11, 2021
The law today
Michigan folds intoxicating hemp into its marijuana system: since October 11, 2021 (2021 PA 56) the MRTMA definition of 'marihuana' covers any product whose total THC (all isomers, including delta-8 and THCA, natural or artificial) exceeds 0.3% or the regulatory per-serving limits, so THC gummies, beverages, delta-8 and THCA flower may be sold only by CRA-licensed marijuana retailers to adults 21+, and the CRA actively enforces against unlicensed stores and online sellers.
Non-intoxicating hemp products (at or under 0.3% total THC) may be sold, but anyone processing, handling, brokering or marketing them - including retailers of CBD tinctures/topicals - must hold a $1,350 annual CRA hemp processor-handler license, and growers must register with MDARD. There is no state age limit or milligram cap for compliant hemp products; SB 599-602 (passed the Senate in 2025-26) and HB 5040-5043 (in House committee as of June 2026) would create a consumable-hemp licensing system with a 1.75 mg THC per serving/container threshold, but neither had been enacted as of September 2026.

Steps to a compliant hemp business in Michigan
- 1
Register the business with Michigan LARA (Corporations Division) and obtain a sales tax license from Treasury
- 2
Growers: submit the MDARD grower registration (registration year Feb 1-Jan 31) and pay sampling/testing fees; only DEA-registered labs may test
- 3
Anyone processing, handling, distributing or marketing hemp products (including CBD retail): obtain the CRA hemp processor-handler license ($1,350/yr, Dec 1-Nov 30) by paper application
- 4
Sell only hemp products at or under 0.3% total THC (delta-9 plus THCA plus all isomers); products above that or any intoxicating THC product require a CRA marijuana establishment license and METRC tracking
- 5
Keep COAs for every product showing total THC; do not sell delta-8, THCA flower or THC beverages without a marijuana license
- 6
Track SB 599-602 and HB 5040-5043 for a future consumable hemp license and the federal 0.4 mg per container definition
