Key law
LA Act 752 (HB 952, 2024) amending La. R.S. 3:1481–1484 (Consumable Hemp) — effective January 1, 2025

The law today

Louisiana permits consumable hemp products through a two-agency system: LDH must register every product (sponsored by a permitted in-state or out-of-state processor) and ATC must permit every retailer (per location and per online domain, $175/yr) and wholesaler; retailers collect a 3% excise tax. Under Act 752 (effective January 1, 2025) products are capped at 5 mg total THC per serving and 40 mg per package, beverages at 5 mg per container of at least 12 oz with no more than four containers per package, tinctures at 1 mg per mL; all inhalable forms (flower, vapes, pre-rolls) are banned, gas stations/convenience stores may not sell, and adult-use products (over 0.5 mg THC per package) may be sold only to people 21+ with photo ID (other products 18+).

Act 345 (effective August 1, 2025) added civil liability for sales to under-21s, and LDH's January 20, 2026 final rule set annual product registration, processor permits, batch COAs with QR codes and child-resistant packaging; no 2026 statutory changes were enacted, and industry litigation against Act 752 remains pending in federal court.

Research notes
ATC's application PDF is titled 'CBD retail dealer permit' but is the consumable hemp retail permit under R.S. 3:1482. A 2026 bill (HB 539) reported as withdrawn could not be independently verified on legis.la.gov; no 2026 enacted changes were found. Per-serving/package caps are taken from the LDH Jan 2026 rule and Act 752 summaries; the enrolled act text also references a 1% total THC concentration ceiling.
Good Hemp Distro market notes
5 mg total THC per serving / 40 mg per package; inhalables and floral hemp banned. Online sales require an ATC remote-retailer permit, LA Secretary of State registration, sourcing from LA-permitted wholesalers and LDH product registration. (Recreational (21+) state dataset, version 2026-09-28)
