Key law
MS Attorney General Opinion No. 2025-00219 (2025-06-11) applying Miss. Code §41-29-113 — effective June 11, 2025

The law today

Mississippi has no state licensing, registration, age limit or THC cap for consumable hemp products and no funded state hemp cultivation program (growers license through USDA under the 2018 Farm Bill; the 2020 Hemp Cultivation Act, Miss. Code §69-25-201 et seq., was never funded). The Attorney General's June 11, 2025 opinion concludes that consumable hemp products containing THC are Schedule I controlled substances unless FDA-approved or sold through licensed medical cannabis dispensaries, while conceding state law does not specifically address ingestible hemp products - so intoxicating hemp sales carry prosecution risk even though products remain widely sold.

HB 1502 (2025), which would have created a Department of Health licensing system with a 21+ age limit and 3% excise tax, died in conference in April 2025, and SB 2645 (2026), which would have banned hemp/THC beverages, died in committee; the federal 0.4 mg per container definition (delayed to December 11, 2026) will be the next binding change.

Steps to a compliant hemp business in Mississippi

  1. 1

Register the business with the Mississippi Secretary of State and obtain a Department of Revenue sales tax permit

  2. 2

Growers: apply for a USDA hemp producer license through the USDA HeMP platform (FBI identity history summary required) and report acreage to FSA

  3. 3

Retailers: limit inventory to non-intoxicating hemp/CBD products with COAs showing total THC at or below 0.3% (and be aware the AG opinion treats any THC-containing consumable as a controlled substance outside medical dispensaries)

  4. 4

Adopt voluntary 21+ ID checks, child-resistant packaging and no health claims, since no state standards exist

  5. 5

To sell THC products lawfully under the AG's reading, obtain a Mississippi Medical Cannabis Program dispensary license from MSDH

  6. 6

Monitor the 2027 session for a renewed consumable hemp bill and prepare for the federal 0.4 mg per container cap

Research notes
Mississippi legislature bill-status pages serve an incomplete TLS chain; they were verified by completing the chain with the public GlobalSign intermediate (all three returned 200 and SB 2645 shows status 'Dead'). The AG opinion is hosted on the Attorney General's official site (attorneygenerallynnfitch.com, not a .gov domain). The Mississippi Code itself is hosted by LexisNexis, so the enacting bill is linked instead of a code URL. Legal status of consumable hemp is genuinely unsettled (AG opinion vs. lack of statute).
Good Hemp Distro market notes
AG opinion treats THC-containing consumable hemp outside licensed medical dispensaries as Schedule I; HB 1502 and SB 2645 died. Local sheriff sweeps reported. (Recreational (21+) state dataset, version 2026-09-28)
