The law today

New Jersey licenses hemp growers and processors/handlers through the Department of Agriculture and, since P.L.2025, c.215 (S4509, signed Jan 12, 2026, effective Jan 13, 2026), treats any hemp-derived product over 0.3% total THC (plant material) or more than 0.4 mg total THC per container, or containing synthesized/non-naturally-occurring cannabinoids, as cannabis regulated by the CRC (products above the limits became 'cannabis' on April 13, 2026).

Selling any THC-containing hemp product to anyone under 21, online sales of intoxicating hemp beverages, and vending-machine sales are banned. P.L.2026, c.7 (S3945, signed Mar 30, 2026) lets ABC-licensed wholesalers/retailers and Class 5 cannabis retailers sell intoxicating hemp beverages only until Nov 13, 2026 (max 750 mL container, resealable if >10 mg THC, ISO 17025/DEA-registered lab tested, $3.75/gallon wholesale tax); after that, beverages over 0.4 mg THC per container must be made by Class 2 cannabis manufacturers and sold by Class 5 retailers.

Non-intoxicating hemp products (โ‰ค0.4 mg total THC/container) remain sellable at general retail.

All links loaded 2026-09-29. Per-serving limits (5 mg/10 mg per container) were removed by P.L.2026, c.7 in favor of a 750 mL container cap; FAQ text and the S3945 introduced text differ slightly, so confirm the enacted chapter law text on njleg.gov. NJ-CRC 'highpoints' article on hemp (May 19, 2026) returned 404. The 2024 law (P.L.2024, c.73) enjoined in Loki Brands v. Platkin has been repealed.
