- F.S. § 581.217 (as amended by SB 1676, 2023); FDACS Rule 5K-4.034 (2025) — effective June 16, 2025
The law today
Florida permits hemp extract products (including hemp-derived THC edibles, beverages and inhalables) that stay at or below 0.3% total delta-9 THC, but regulates them as food under s. 581.217, F.S. and Rule 5K-4.034: every manufacturer, packer and retailer must hold an FDACS Hemp Food Establishment Permit, products need an independent-lab COA reachable by QR code, child-resistant packaging (ASTM D3475) and labels that are not attractive to children (the November 2, 2025 amendment defines 'cartoon'), and sales – in store and online – are limited to buyers 21+.
The March 12, 2025 rule amendment added food-grade safety/testing standards; bills to cap THC per serving/package (SB 1698 in 2024, vetoed; SB 438 in 2025 and HB 1409 in 2026, died) have not become law, so Florida has no milligram cap, but the federal P.L. 119-37 hemp definition change will apply from its delayed effective date. Cultivation licenses are free from FDACS Plant Industry.

- fdacs.gov is a JavaScript-rendered site that disallows the fetch tool; the FDACS URLs returned HTTP 200 and match the pages indexed by search engines (Hemp Food Establishment Permit; Hemp Cultivation Licensing, which is also the page cited in FDACS's own applicant-checklist PDF), but their text could not be machine-verified. The $650 permit fee is from an industry compliance summary. The flsenate.gov statute and flrules.org rule pages were fetched and confirmed. HB 1409 died; no 2025–2026 statutory THC cap exists.
